Terms and Conditions for Fat e Bike Rentals – Bicycle Rental Service and Website Platform Usage

Definition of Terms

  1. Fat e Bike Rentals: Pertains to Fat e Bike Rentals, the entity offering biking services and facilitating reservations through its website platform.
  2. Bicycle: Denotes the (e-)bike and any included items within the contractual agreement.
  3. Customer: Refers to the individual or legal entity procuring biking services or tours from Fat e Bike Rentals.
  4. Rider: Represents the person actively using the bicycle.
  5. Written: Encompasses both written and electronic communication.
  6. Website Platform: Signifies the online platform managed by Fat e Bike Rentals, serving the purpose of streamlining bike rental and tour reservations.

Article 1: Applicability

1.1. These general terms and conditions extend to all agreements between Fat e Bike Rentals and customers for bike tours or rental, inclusive of accessory items, accessed through the website platform.

Article 2: Offer and Agreement

2.1. Fat e Bike Rentals formulates a written or verbal proposal based on customer preferences, outlining specifics such as service type, rental duration, and associated costs.

2.2. Agreement initiation transpires when the customer accepts an offer from Fat e Bike Rentals, whether through the website platform or alternative means.

2.3. Ownership of rented bikes and accessories remains vested in Fat e Bike Rentals throughout the rental period.

Article 3: Price and Duration

3.1. Bikes should be returned to the designated location within the stipulated business hours of Fat e Bike Rentals.

3.2. A day is acknowledged as a 24-hour period.

3.3. Refunds are not applicable for bikes returned prior to the contractual conclusion.

3.4. In cases of exceeding the rental period, Fat e Bike Rentals may levy charges, incrementally, for each additional hour and day.

3.5. Failure to return a bicycle promptly empowers Fat e Bike Rentals to reclaim it immediately.

Article 4: Cancellations

4.1. Cancellation fees are structured as follows:

4.1.1. Up to 48 hours before the tour or commencement of bike rental: 0% of the price.

4.1.2. Between 48 and 24 hours in advance: 50% of the price.

4.1.3. Within 24 hours or less: 100% of the price.

4.2. Cancellation requests should be communicated via email (shop@fatebikerentals.com).

Article 5: Payment and Deposits

5.1. Payments for bike rental and tours are obligatory in advance.

5.2. Security deposits are mandatory for each bike and can be settled in cash or through debit/credit cards.

5.3. Refunds for deposits occur upon bike return, after deducting any charges incurred for damages during the rental period.

5.4 When using the online booking platform a small percentage of the order is charged at the time of booking. This serves as a booking deposit and helps to mitigate for lost income due to no shows or cancelled bookings.

Article 6: Obligations for the Customer

6.1. Customers are entrusted with the responsible handling of bicycles in line with their intended purpose.

6.2. Bicycles must be returned to Fat e Bike Rentals in their original condition, with any customer-induced alterations reversed.

6.3. By opting for bike rental or engaging in a bike tour, customers affirm:

6.3.1. Good physical condition, devoid of medical issues affecting riding capability.

6.3.2. Proficiency in bicycle riding.

6.4. Fat e Bike Rentals retains the prerogative to assess customer and rider capabilities before bike usage.

6.5. Adherence to national traffic laws and compliance with instructions from Fat e Bike Rentals staff are prerequisites for customers.

6.6. Customer/riders must comply with stipulations, including refraining from subletting, restricting bike usage to designated areas, and adhering to passenger limits.

Article 7: Additional Instructions for the Customer

7.1. Bicycles must be returned in a clean state, with potential cleaning costs applicable.

7.2. Customers should retain a copy of the contract when returning bikes.

7.3. Proper locking of bicycles when unattended is imperative, with lock usage instructions available from Fat e Bike Rentals staff.

7.4. Customers are obligated to inspect bikes at the onset, report any defects, and acknowledge bike condition upon departure from the premises.

7.5. Troubleshooting in Amsterdam necessitates a visit to Fat e Bike Rentals shops; external repairs are only reimbursed if pre-approved. Reporting injury, damage, or loss promptly is the customer’s responsibility.

Article 8: Obligations for Fat e Bike Rentals

8.1. Fat e Bike Rentals ensures the provision of bicycles with agreed features, well-maintained, clean, and technically sound.

8.2. Pre-existing damages are documented in the customer’s presence.

8.3. Immediate bicycle inspection transpires upon return.

Article 9: Customer’s Liability for Damage

9.1. Customer liability extends to damages incurred by Fat e Bike Rentals due to bike rental or tours, unless attributed to a breach of obligations outlined in Article 8.

9.2. The customer is accountable for actions of riders and other bicycle users, even without explicit customer authorization.

9.3. Bicycle usage is undertaken at the customer’s risk, absolving Fat e Bike Rentals of liability for infringements of Dutch rules or regulations.

9.4. Compensation for loss, theft, or damage may be levied by Fat e Bike Rentals, based on specified amounts and repair costs.

Article 10: Assurance

10.1. Fat e Bike Rentals presents an assurance service to mitigate financial risk in cases of bike damage or theft.

10.2. Assurance costs are included in the rental prices.

10.3. The service encompasses coverage for theft and all forms of bicycle damage, featuring a designated deductible.

10.4. The mitigated costs are as follows;

10.4.1. Stolen or lost or damaged beyond repair; €450.00 euros.

10.4.2. Stolen or lost battery; €300.00 euros.

10.4.3. Damage;

10.4.3.1. Up to and including €250.00 in damage €50.00 euros.

10.4.3.2. Up to and including €500.00 in damage €100.00 euros.

10.4.3.3. Up to and including €1000.00 in damage €200.00 euros.

10.4.3.4. Anything above €1000.00 is considered damaged beyond repair and falls under 10.4.1.

Article 11: Dissolution of the Contract

11.1. Fat e Bike Rentals retains the right to terminate the contract and repossess the bicycle in the event of customer obligation violations or legal issues.

11.2. Customer cooperation is imperative in scenarios where Fat e Bike Rentals is entitled to repossess the bicycle.

11.3. In cases of customer demise before the hire period concludes, automatic contract dissolution transpires.

11.4. Fat e Bike Rentals is indemnified from liabilities arising from contract dissolution.

Article 12: Personal Data

12.1. Processing of personal data aligns with the European Union General Data Protection Regulation.

12.2. Customers reserve the right to request inspection or correction of personal data and file objections, particularly concerning direct mailing.

Article 13: Applicable Law

13.1. Dutch law governs the contractual agreement.

Article 14: Website Platform Terms of Use

14.1. The website platform, managed by Fat e Bike Rentals, serves the purpose of streamlining bike rental and tour reservations.

14.2. Users engaging with the website platform are required to adhere to the following terms:

14.2.1. Provision of accurate and truthful information during the reservation process is mandatory.

14.2.2. The website platform should only be utilised for lawful purposes.

14.2.3. Any activity disrupting or interfering with the website’s functionality is strictly prohibited.

14.3. Fat e Bike Rentals reserves the prerogative to suspend or terminate access to the website platform for users violating these terms.
